Patient Terms & Conditions

Galenic Laboratories Limited trading as Roseway Labs (company number 11155161) (referred to as “Roseway Labs”, "we", "us" or "our" in these terms), is a company registered in England and Wales and our registered office is at Ground Floor, Unit D, Zetland House, 5-25 Scrutton Street, London EC2A 4HJ. We are GPhC regulated with registration number 9011719.

These Terms & Conditions apply to the order you are about to make with Roseway Labs.  We may change these Terms & Conditions from time-to-time.  Your order and these Terms & Conditions shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.

You are making this order because your medical prescriber has sent us a legal prescription, requesting this medication.  Please make sure that you read the patient information leaflets that will accompany your medication, when you receive it.

Should you have any adverse reaction to the medication that we send you, please contact either your medical prescriber or Roseway Labs.  We will advise and support you and your prescriber and we log all adverse reactions using the Yellow Card scheme.

We will send your medication using the delivery option that you have selected.  In the event that medication does not arrive, or arrives damaged, you must notify us as soon as possible. Medication will only be re-issued where it is clear that the medication has not been delivered or where we cannot trace the medication.

Once your order is paid, it will be scheduled for compounding and/or dispensing.  At this point, the order cannot be changed or cancelled. If we have not yet scheduled the order, we may in our discretion cancel the order, upon request.  Once medication has been dispensed, it cannot be returned or refunded unless it is a defective product or we have dispensed incorrect products.  We accept returned medication for safe disposal.

Data Protection

In this clause, the following definitions shall apply:

Agreed Purposes means in relation to providing medications to Patients.

“Controller, processor, data subject, personal data, personal data breach, processing and appropriate technical and organisational measures” have the meanings as set out in the Data Protection Legislation.

“Data Protection Legislation” means all applicable data protection and privacy legislation in force from time to time in the UK including the UK GDPR as defined by section 3(10) (as supplemented by section 205(4)) of the Data Protection Act 2018.; the Data Protection Act 2018 (DPA 2018) (and regulations made thereunder); the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data (including, without limitation, the privacy of electronic communications); and the guidance and codes of practice issued by the Information Commissioner or other relevant regulatory authority and applicable to a party.

“Shared Personal Data” means the personal data to be shared between a Prescriber and Roseway Labs.  Shared Personal Data shall be confined to the following categories of information relevant to the following categories of data subject:

Personal data about Patients including:

·       Title, first name, surname

·       Postal and billing addresses

·       Email address

·       Phone number

·       Date of birth

·       Details of medications prescribed (this is special category personal data)

Roseway Labs and your Prescriber are joint Data Controllers and will comply with all the obligations imposed on a controller under the Data Protection Legislation.  In particular, Roseway Labs will:

(a)  process the Shared Personal Data only for the Agreed Purposes;

(b)  not disclose or allow access to the Shared Personal Data to anyone other than its employees and data processors, your prescribing doctor or clinic; you or your authorised representatives; or as otherwise required by law.

(c)  ensure that it has in place appropriate technical and organisational measures to protect against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

(d)  not transfer any Shared Personal Data outside the UK unless we have ensured that (i) the transfer is to a country approved under the applicable Data Protection Legislation as providing adequate protection; or (ii) there are appropriate safeguards or binding corporate rules in place pursuant to the applicable Data Protection Legislation; or (iii) we have ensured that there is an adequate level of protection to any personal data that is transferred; or (iv) one of the derogations for specific situations in the applicable Data Protection Legislation applies to the transfer.
